Judge Dismisses Halle Berry Restraining Order Request in Custody Case With Olivier Martinez

A Los Angeles judge has dismissed Olivier Martinez’s request for a domestic violence restraining order against Halle Berry and lifted the temporary restrictions placed on the actress, Page Six reported on Thursday. The ruling ends a hearing that ran for almost two weeks, although custody arrangements will return to court at a future hearing.
What the judge decided
Los Angeles Superior Court Judge Shelley Kaufman tossed out Martinez’s request for an order protecting himself and their 13-year-old son, Maceo, and lifted the temporary restrictions imposed on Berry, Page Six reported. Berry has accused Martinez of escalating their custody dispute by alleging that she abused their teenager, according to Page Six.
Berry’s attorney, Marina Beck, told Page Six: “We are extremely pleased that the Court has dissolved the TRO. As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family.” A source added: “This is a huge win for Halle,” Page Six reported. Martinez’s attorney did not immediately respond to Page Six’s request for comment.
The evidence heard
Judge Kaufman’s decision followed nearly four hours of sealed testimony from Maceo on 19 October, the first day of the hearing, Page Six reported. His therapist and a school official also took the stand. The teenager’s testimony was held behind closed doors, with both parents ordered out of the courtroom, according to earlier reporting on the hearing.
Earlier in the week, the judge had also denied a bid to reopen evidence over a post that appeared on Berry’s Instagram account, as Starlight News reported on 28 October, citing Page Six and TMZ.
The background to the case
Martinez had accused Berry of physically abusing their son, an allegation Berry has denied, Page Six reported. Berry’s legal team has previously described Martinez’s claims as “entirely meritless and deliberately misleading,” according to Page Six. A temporary restraining order was granted on 1 October, along with temporary primary physical custody for Martinez and limits on Berry’s parenting time, earlier reporting said.
Berry had asked the court to dismiss the request and restore the previous 50-50 physical custody arrangement, while seeking sole legal custody over Maceo’s education, therapy and medical care, Page Six reported.
What stays in place
Page Six confirmed that the custody arrangement put in place under the temporary restraining order will remain until a future hearing. Martinez will retain primary physical custody, while he and Berry will continue to share legal custody. Baller Alert reported the same outcome: Martinez remains responsible for primary physical care, while Berry retains legal custody rights and court-authorised visitation.
The ruling ends the restraining-order request, but not the wider custody dispute, which will be decided at a future hearing.
