Halle Berry Restraining Order Extended as Custody Battle With Olivier Martinez Enters Second Week

The temporary restraining order Olivier Martinez obtained against his ex-wife Halle Berry has been extended through the weekend, as the former couple’s heated custody battle over 13-year-old son Maceo spilled into a second week of hearings, Page Six reported Friday.
The pair returned to the Stanley Mosk Courthouse in Los Angeles for a fifth day of hearings on Friday. Martinez, 60, continued his closed-door testimony from Thursday, doubling down on his claims that Berry abused him during their relationship — even after her attorney, Marina Beck, confronted him with a sworn 2024 declaration in which he stated the couple had no history of domestic violence.
Martinez’s lawyer, Patrick Baghdaserians, told Page Six the 2024 declaration was signed in connection with a financial request. “There was no conviction of domestic violence at the time,” he said, adding that no restraining order had been requested at that point. After a lunch break, Berry’s fiancé, musician Van Hunt, 56, took the stand behind closed doors. Hunt appeared relieved when he finished around 4 p.m., Page Six reported, and was later seen laughing with a member of Berry’s legal team.
What’s at stake
The hearing stems from Martinez’s allegation that the Oscar winner choked their teen son during a confrontation at her home on September 26. Martinez has claimed the incident reflects ongoing abusive behavior, and that Maceo reached out to him afterward asking to be picked up. Berry vigorously denies the allegations — her attorney has called them “entirely meritless and deliberately misleading.” Maceo testified for nearly four hours in closed proceedings earlier in the week, and Berry herself testified on Thursday. A judge previously granted Martinez the temporary restraining order and temporary primary custody of Maceo, limiting Berry’s time with the teen.
What happens next
The hearing resumes Monday, when Berry’s 18-year-old daughter Nahla Aubry is expected to testify virtually, Page Six reported. Nahla previously submitted a court declaration stating she had never seen her mother abuse Maceo. Berry has asked the court to dismiss the restraining order and restore the previous 50/50 physical custody arrangement, while seeking sole legal custody so she can oversee Maceo’s education, therapy and medical care.
